These Terms of Service ("Terms") govern your use of the goFlySURF website at goflysurf.com and all services provided by goFlySURF LLC ("we," "us," or "the Company"), including eFoil lessons, rentals, demos, retail sales, and events. By booking a session, purchasing equipment, or using our website, you agree to these Terms.
All sessions must be booked in advance through our online booking system or by contacting us directly. Bookings are confirmed only upon receipt of payment. We reserve the right to cancel or reschedule any session due to weather, equipment issues, permit restrictions, or other circumstances beyond our control.
We accept all major credit cards, Apple Pay, and Google Pay. A credit card authorization hold is placed at the time of booking. The hold is captured after your session is complete. Multi-day rentals require a credit card authorization hold at booking. The hold is captured or released upon confirmed return of equipment in acceptable condition.
goFlySURF reserves the right to cancel any session due to lightning, sustained winds above 15 mph, water conditions deemed unsafe, or any other factor our instructors determine poses unreasonable risk. In such cases, customers receive a full reschedule credit valid for 12 months. We monitor conditions proactively and will contact customers as early as possible.
All participants must meet the following requirements before participating in any goFlySURF activity:
goFlySURF instructors have absolute discretion to deny participation to any individual they believe poses a safety risk, without refund obligation beyond our standard cancellation policy.
All rental equipment is provided in good working condition. Renters are responsible for returning equipment in the same condition, reasonable wear excepted. Damage beyond normal wear is the renter's financial responsibility at current replacement cost. Renters must complete an in-person safety and equipment care briefing before taking possession of rental equipment.
Delivery service is available throughout Utah County and Salt Lake County for a small fee — call us for current rates. Delivery outside these counties may be arranged at additional cost. We are not responsible for delays caused by traffic, road conditions, or circumstances beyond our control.
All SiFly product prices reflect the manufacturer's Minimum Advertised Price (MAP). Prices are subject to change without notice. We will honor the price at the time of your confirmed order.
SiFly products ship from their U.S. distribution point. Estimated lead times are 1–3 weeks and are provided in good faith but are not guaranteed. We are not responsible for manufacturer or shipping delays. We will communicate any significant delays as soon as they become known.
New, unused equipment in original packaging may be returned within 14 days of receipt for a full refund less a 10% restocking fee. Equipment that has been assembled, used, or taken on the water is non-returnable. Warranty claims are handled directly through SiFly's 2-year warranty program with our assistance as your local dealer.
All website content, including text, graphics, logos, and page designs, is the property of goFlySURF LLC and may not be reproduced without written permission. SiFly product names, images, and descriptions are the intellectual property of SiFly and are used with authorization as an authorized dealer.
To the maximum extent permitted by Utah law, goFlySURF LLC's total liability for any claim arising from these Terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim. goFlySURF is not liable for indirect, incidental, consequential, or punitive damages of any kind.
These Terms are governed by the laws of the State of Utah. Any dispute shall be resolved exclusively in the courts of Utah County, Utah, or the U.S. District Court for the District of Utah, Central Division.

goFlySURF LLC ("we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use it, and your rights regarding your data. By using our website or services, you agree to this policy.
Signed waivers and associated participant data are retained for a minimum of 7 years from the date of the activity. This retention period is required for legal defensibility and insurance compliance. Waiver data is stored securely and is not sold or shared except as required by law.

If you have signed our media release (included in the waiver), photos or videos taken during your session may be used on our website, social media, or marketing materials. You may request access to, correction of, or deletion of your personal information by contacting us at goFlySURF@gmail.com. We will respond within 30 days. Note that waiver records cannot be deleted during the required retention period.
We use industry-standard security measures including encrypted connections (HTTPS), secure payment processing through Stripe, and access controls on our systems. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
Our website uses cookies for analytics (Google Analytics) and functionality. You may disable cookies in your browser settings, though some features of the site may not function properly. We do not use advertising tracking cookies.
We do not knowingly collect personal information from children under 12 without parental consent. For minor participants aged 12–17, we collect information necessary for their participation with parent or guardian knowledge and consent.
